Rock-Tacular Official Rules:
The Contest is open to all registered users of the Guitar Hero III Community who are legal residents of the 48 continental United States and the District of Columbia. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. Your entry constitutes your full and unconditional agreement to and acceptance of these Official Rules and Regulations and the decisions of the Guitar Hero III Community Moderators, which are final and binding on all matters pertaining to this Contest.
Contest Overview
The Gamespot Rock-Tacular Event is a multiple day tournament event starting on April 4th, at 12AM GMT (8PM EST) and ending on or around April 20th, at 12AM GMT (8PM EST). The event will be to obtain the highest score(s) within consecutive rounds for the opportunity to win a trip to the Gamespot Studios in San Francisco, and a $1,000 in prizes.
Player Eligibility
a) The Guitar Hero III Community requires all participants be a minimum of 18 years of age at the date of the event in order to participate in the Contest. Anyone under the age of 18 may not participate in the Contest. Should you be a minor in your state of residence, you must have your parent or legal guardian’s permission to enter the Contest.
b) Participants in the Contest agree to provide their legal surname as well as their legal first name and middle initial or middle name upon request if they win. Aliases or nicknames may not replace their legal names in the Contest.
c) Participants must have registered accounts within the Guitar Hero III Community and they must be the sole Account Creator (defined below).
d) Directors, officers, and employees of the Guitar Hero III Community, CNET Networks, Inc., Red Octane, Activision, Neversoft and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, or any other person or entity involved in the design, production, execution, or distribution, of the Contest, and the immediate families of each (spouse, parent, child, sibling, and their respective spouses) and those living in the same households are not eligible to enter the Contest or win any prizes.
e) An Account Creator is defined as the natural person to whom an e-mail address is assigned by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All federal, state and local laws and regulations apply. Void where prohibited or restricted by law.
f) Participants agree that they may not provide forged, fraudulent, false, or misleading information. All participants are subject to verification. If a participant is found to contain forged, fraudulent, false, or misleading information, the participant will be removed from the Contest as well as their submission in the Contest.
g) The Guitar Hero III Community reserves the right at all times to disclose any information obtained during account creation as the Guitar Hero III Community Management deems necessary to satisfy any applicable law, regulation, legal processes or governmental authority request, or to edit, refuse, or remove any information, in whole or in part, at the sole discretion of the Guitar Hero III Community Management. Participants agree that their contact information may be disclosed to GameSpot for prize fulfillment purposes.
Prizes
The four winning contestants from the semifinal round of the Contest will each receive one travel package to San Francisco, CA to compete against the other contestants in a live finals event occurring on May 9, 2007. Package will include one roundtrip economy class plane ticket (from the nearest major continental U.S. city to the San Francisco International Airport) (approximate retail value ("ARV") $600), and two nights single occupancy hotel accommodations (room rate and related taxes only) (ARV $500) (Total ARV of travel prize = $1100) (Total ARV of all prizes = $6600).
The winning contestants may be contacted by GameSpot and will be required to register with GameSpot.com and review and agree to the official rules for the live finals event. All winners will be notified by e-mail at the e-mail address associated with their Guitar Hero III Community accounts. To claim their prize, winners must complete and return a notarized Affidavit and General Release and, if applicable, a W-9 form sent to winner, within five (5) days of notification. If winner is a resident of a state that deems him or her to be a minor, the prize may be awarded in the name of winner's parent/legal guardian, who must also sign a notarized Affidavit and General Release on the winner's behalf and grant consent for the winner to accept the prize. Any prize notification or prize returned to prize Sponsor as undeliverable will be forfeited. Each potential winner may be requested to provide Guitar Hero III Community Management with proof that he or she is the Account Creator of the e-mail address that corresponds to the registered account used to enter the Tournament. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the Account Creator of said e-mail account. Limit one (1) prize per person. You are not a winner until your submission is validated and your documents are completed.
All federal, state and local taxes are the sole responsibility of the winner. 1099 tax statements will be filed with the IRS for any winner whose prize value is or exceeds $600. Prizes will be awarded “as is” with no warranty or guarantee, either express or implied by prize Sponsor. Prizes cannot be transferred, substituted or redeemed for cash, except by prize Sponsor, in its sole discretion. Actual value of prize depends on the city of departure, time of travel, any airfare fluctuations, and any difference between the stated ARV and the actual value, if any, will not be awarded. All other expenses (including without limitation transportation to and from departure city, gratuities, incidental expenses, insurance and meals) not expressly stated herein are the sole responsibility of finalists. Travel arrangements will be made through the travel coordinator designated by prize Sponsor. Travel dates are to be determined and trip must be taken on dates and times designated by prize Sponsor or prize will be forfeited. Travel restrictions may apply and frequent flyer miles may not be available. One or more stopovers may be required on air transportation. Once travel is booked, no changes or cancellations will be accepted. No extensions or exceptions shall apply or be available. All travel is subject to availability and finalist is solely responsible for obtaining all necessary and required travel documents. Prize Sponsor shall not be responsible for any lost or stolen tickets or similar items once they are in the winner’s possession. Prize Sponsor shall not be responsible nor liable for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carriers, hotels or others providing services or accommodations, including loss or damage to baggage.
Liability and Agreement
All prizes mentioned and awarded in the Contest are promised for supply by third party prize Sponsors. The Guitar Hero III Community management and CNET Networks, Inc. is not responsible for any deficiency or delay in the delivery, condition, or value of any prizes or award. Participants (or their parent/legal guardian should they be a minor in their state of residence) agree to release, discharge and hold harmless The Guitar Hero III Community, CNET Networks, Inc., and Sponsors and their respective affiliates, subsidiaries, divisions, directors, officers, employees, volunteers, agents, and assigns including advertising and promotion agencies, and promotion partners (the “Released Parties”), from any and all liability whatsoever, and to waive any and all causes of action related to any claims, costs, injuries, losses, taxes, expenses, or damages of any kind, either at law or in equity, whether known or unknown (collectively, "Losses"), arising, in whole or in part, directly or indirectly, out of or in connection with this Contest or any Contest-related activity, or that the winners might incur as a result of this Contest or acceptance, possession, or use or inability to use any prize (including, without limitation, Losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, and defamation or portrayal in a false light, whether intentional or unintentional), or for any printing, production, typographical, human, or other error in the printing, offering, or announcement of any prize, whether under a theory of contract, tort (including negligence), warranty, guarantee (express or implied), or other theory. Winners (or their parent/legal guardian should they be a minor in their state of residence) further acknowledge that Released Parties are not liable for any warranty, representation, or guarantee express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness.
Intellectual Property
The Guitar Hero III Community Management and CNET Networks, Inc. reserves the right to reproduce, archive, publish, display, exhibit for promotional purposes, without credit or notification, any derivative work, article, feature, video, program, picture, item, art or printed coverage of the Contest and all of its participants.
Unauthorized replication, publication, or copying of this, in whole or in part, is prohibited.
The game and the name “Guitar Hero III: Legends of Rock” and the guitar controller are used for purposes of prize description only and such use is not intended to suggest or imply Activision and RedOctane’s sponsorship, endorsement, or the approval of this Contest.
